Texas bishops' statement on Fifth Circuit's decision regarding DACA recipients

AUSTIN – With the decision earlier this year by the U.S. Court of Appeals for the Fifth Circuit in Texas v. United States, which is likely to impact the lawful presence of people in the Deferred Action for Childhood Arrivals (DACA) program residing in Texas (and not any other state), the Catholic bishops of Texas have issued the following statement:

A federal court decision is imminently expected to change nearly 90,000 Texans’ presence in our country from lawful to unlawful. This decision will impact virtually every community in Texas by removing the lawful presence for DACA recipients who live in Texas. We, the Catholic bishops of Texas, firmly resolve to respond with compassion and a call for justice for those who, through no fault of their own, are now being forced to abandon their homes, their livelihood and their communities.

This action further undermines each of these persons’ basic human right to seek work and to support a family. It is contrary to the facts to claim that our state is harmed by DACA recipients lawfully working here. Instead, this kind of unprecedented and disruptive action by our government will harm our communities by fomenting fear, severing relationships, disrupting business and removing some of the most upstanding individuals from our community.

The present distress in our country regarding immigration is the result of decades of unwillingness on all sides to enact reasonable and meaningful immigration reform, reform which respects both national security needs and the human right of each person to work and raise a family in peace.

We will continue to work with people of goodwill to encourage compassionate outreach to those in dire predicaments and a humane reform of our terribly broken immigration system.

As we begin considering the anticipated implications of this ruling on our communities, including fear and familial estrangement, we respectfully remind federal and state authorities of the importance of proper training and supervision for ICE agents. No violent actions should ever be taken or justified to harm law enforcement officials or their families. The human dignity of law enforcement officers themselves is violated when they are expected to consider brutal and inhumane methods to enforce these decisions.

The unreasonableness and impending implementation of the Fifth Circuit’s ruling, targeting law-abiding people working and living in Texas, places a terrible burden on our communities. We are pastors of ICE agents and DACA recipients, undocumented persons and families whose security is threatened. This decision will only exacerbate fear and distrust, pit community members against one another, and cause significant economic disruption for many communities.

We want to say unequivocably to all our immigrant sisters and brothers, and in a particular way to those who arrived as children: We have heard your cries. We are with you in these difficult days.

May God, who hears the cry of the poor, move all of us to bring his mercy and justice to our country.

AUSTIN – Tras la decisión emitida este año por el Tribunal de Apelaciones del Quinto Circuito de EE.UU. en el caso Texas contra Estados Unidos, que probablemente afectará la situación legal de las personas inscritas en el programa de acción diferida para los llegados en la infancia (DACA) que residen en Texas (y no en ningún otro estado), los obispos católicos del estado han emitido la siguiente declaración:

Se espera de manera inminente una decisión de un tribunal federal que cambiará la situación de casi 90,000 texanos, cuya presencia en nuestro país pasará de ser legal a ilegal. Esta decisión afectará prácticamente a todas las comunidades de Texas al eliminar la legalidad de la presencia de los beneficiarios de DACA que viven en Texas. Nosotros, los obispos católicos de Texas, nos comprometemos firmemente a responder con compasión y a exigir justicia para aquellos que, sin culpa alguna, se ven ahora obligados a abandonar sus hogares, sus medios de subsistencia y sus comunidades.

Esta acción socava aún más el derecho humano fundamental de estas personas a buscar trabajo y mantener a una familia. Es contrario a la realidad afirmar que nuestro estado se ve perjudicado por los beneficiarios de DACA que trabajan aquí de manera legal. En cambio, este tipo de acción disruptiva y sin precedentes por parte de nuestro gobierno, perjudicará a nuestras comunidades al fomentar el miedo, romper relaciones, interrumpir la actividad económica y expulsar a algunas de las personas más respetables de nuestra comunidad.

Los desafíos actuales en nuestro país en materia migratoria son el resultado de décadas de renuencia por parte de todos a implementar una reforma migratoria razonable y significativa, que respete tanto las necesidades de seguridad nacional como el derecho humano de toda persona a trabajar y formar una familia en paz.

Continuaremos trabajando con personas de buena voluntad para promover tanto el compromiso humanitario con quienes se encuentran en situaciones desesperadas como con una reforma humanitaria de nuestro sistema migratorio, el cual presenta graves deficiencias.

Al comenzar a considerar las implicaciones que esta decisión tendrá en nuestras comunidades, incluyendo el temor y el distanciamiento familiar, recordamos respetuosamente a las autoridades federales y estatales la importancia de la capacitación y supervisión adecuadas para los agentes de ICE. Jamás debe ser considerado ni justificado acto de violencia alguno en daño de los agentes del orden. La dignidad humana de los propios agentes del orden se ve violada cuando se espera que consideren métodos brutales e inhumanos para hacer cumplir estas decisiones.

La irracionalidad y la inminente implementación de la decisión del Quinto Circuito, dirigida a personas respetuosas de la ley que trabajan y viven en Texas, impone una terrible carga a nuestras comunidades. Somos pastores de agentes de ICE y de beneficiarios de DACA, de personas indocumentadas y de familias cuya seguridad se ve amenazada. Esta decisión solo exacerbará el temor y la desconfianza, enfrentará a los miembros de la comunidad entre sí y causará una importante perturbación económica en muchas comunidades.

Queremos decirles inequívocamente a todos nuestros hermanos y hermanas inmigrantes, y de manera especial a quienes llegaron siendo niños: Hemos escuchado sus súplicas. Estamos con ustedes en estos tiempos difíciles.

Que Dios, que escucha el clamor de los pobres, nos impulse a todos a atraer su misericordia y su justicia a nuestro país.
